1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the website operated by Financial Trust Oversight Union ("FTO-Union", "we", "us", or "our") at www.fto-union.com and any related pages, tools, forms, databases, and online services (collectively, the "Site").

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy and Cookie Policy. If you do not agree, you must not use the Site.

If you use the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. About FTO-Union

FTO-Union is an independent investor-protection and legal services organisation focused on investigating investment fraud, supporting asset recovery, and publishing regulatory and broker oversight information. We may work with lawyers, former regulators, forensic specialists, and partner institutions in the course of our activities.

Important: FTO-Union is not a government agency, court, police force, or financial regulator. References to regulatory frameworks, audits, or enforcement on the Site are informational unless we expressly state otherwise in a signed engagement letter or formal agreement with you.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding agreement to use the Site. By using the Site, you represent that you meet these requirements and that all information you provide is accurate and complete to the best of your knowledge.

4. Permitted use of the website

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • use the Site in any way that violates applicable local, national, or international law;
  • submit false, misleading, defamatory, or malicious complaints or messages;
  • impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • upload malware, viruses, or harmful code, or attempt to gain unauthorised access to our systems;
  • scrape, crawl, harvest, or systematically extract data from the Site except as permitted by law or with our prior written consent;
  • interfere with or disrupt the Site, servers, or networks connected to the Site;
  • use automated tools to overload, probe, or circumvent security or rate limits; or
  • use the Site to harass, threaten, or harm others.

We may monitor use of the Site to protect security, enforce these Terms, and improve our services.

5. No legal, financial, or regulatory advice

Content on the Site—including articles, guides, regulation summaries, news items, FAQs, and general descriptions of our services—is provided for general information only. It does not constitute legal advice, financial advice, investment advice, tax advice, or a recommendation to buy, sell, or hold any financial product.

You should not rely on Site content as a substitute for professional advice tailored to your circumstances. Before making decisions about investments, complaints, litigation, or regulatory reporting, you should consult qualified professionals and, where appropriate, your local regulator or law-enforcement agency.

No client-advisor, solicitor-client, or fiduciary relationship is created between you and FTO-Union solely because you browse the Site, use our broker lookup tool, or submit an enquiry. A formal client relationship arises only when we confirm it in writing.

6. Broker lookup and audit information

The Site includes a broker lookup tool and published audit records derived from publicly available regulatory information, third-party sources, and our internal review processes. Audit statuses such as "Safe", "Watchout", or "Danger" are summary classifications intended to help investors perform due diligence. They reflect our assessment at the time of publication and may change without notice.

You acknowledge and agree that:

  • audit ratings and broker listings are not guarantees of a firm's legitimacy, solvency, or future conduct;
  • a "Safe" rating does not mean an investment is suitable for you or free from risk;
  • a "Watchout" or "Danger" rating is not a formal regulatory finding or court judgment;
  • brokers may operate under multiple names, domains, or jurisdictions not captured in our database;
  • unaudited firms are flagged for caution but absence from our database does not prove a firm is legitimate; and
  • you remain responsible for verifying licensing, terms, and risks before transferring funds to any broker or platform.

If you believe our audit information is inaccurate, you may contact us with supporting evidence. We will review credible corrections but are not obliged to publish every requested change.

7. Complaints and contact services

The Site allows you to submit complaints and contact requests. By submitting information, you confirm that:

  • you have the right to provide the information and documents you upload;
  • your submission is truthful to the best of your knowledge;
  • you will not include passwords, PINs, private keys, or unnecessary sensitive credentials; and
  • you consent to our processing of your information as described in our Privacy Policy.

Submitting a complaint does not automatically initiate formal legal proceedings, guarantee case acceptance, or create an obligation for us to pursue recovery on your behalf. We reserve the right to decline matters that fall outside our scope, lack sufficient evidence, involve conflicts of interest, or are otherwise unsuitable.

Response times stated on the Site (such as review within 48 hours or reply within one business day) are targets only and may vary due to volume, complexity, holidays, or force majeure events.

8. No guarantee of recovery

Investment fraud and cross-border asset recovery are inherently uncertain. FTO-Union does not guarantee that funds will be recovered, that a complaint will result in prosecution, that a regulator will act, or that any particular outcome will be achieved.

Any references to past results, case studies, or recovery statistics on the Site are illustrative only and do not promise similar outcomes in your matter. Fees, success conditions, and scope of work for paid services—if offered—will be set out separately in writing.

9. Accounts and communications

Most Site features do not require registration. Where we issue a case or inquiry reference number, you are responsible for keeping it secure and using it in future correspondence. We may communicate with you by email, phone, or post using the contact details you provide. You are responsible for ensuring your contact information remains accurate.

10. Intellectual property

The Site and its content—including text, graphics, logos, page layout, audit classifications, databases, and software—are owned by FTO-Union or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may view, download, and print reasonable portions of the Site for personal, non-commercial use, provided you do not remove proprietary notices. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit Site content without our prior written consent, except as permitted by law.

"FTO-Union" and related branding may not be used in a manner that suggests endorsement or affiliation without permission.

11. Your submissions

By submitting complaints, messages, documents, or other content to us ("User Content"), you grant FTO-Union a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, analyse, and disclose User Content as reasonably necessary to assess your matter, provide services, comply with law, and protect investors.

You retain ownership of your User Content. You represent that your User Content does not infringe third-party rights or violate law. We may remove or refuse content that is abusive, unlawful, or unrelated to our services.

12. Third-party content and links

The Site may include links to third-party websites, news sources, broker platforms, and regulator pages. We do not control and are not responsible for third-party content, availability, or practices. Links are provided for convenience and do not imply endorsement.

News summaries and regulatory excerpts on the Site may be abridged or time-sensitive. You should verify important information with primary sources.

13. Disclaimers

To the fullest extent permitted by applicable law, the Site and all content are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability.

We do not warrant that the Site will be error-free, secure, or free of harmful components, or that defects will be corrected.

14. Limitation of liability

To the fullest extent permitted by law, FTO-Union and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages.

To the extent liability cannot be excluded, our total aggregate liability for any claim arising out of or relating to the Site or these Terms will not exceed the greater of (a) the amount you paid us specifically for the service giving rise to the claim in the twelve (12) months before the event, or (b) one hundred Australian dollars (AUD $100), except where applicable law requires otherwise.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where such exclusion is prohibited.

15. Indemnity

You agree to indemnify, defend, and hold harmless FTO-Union and its personnel from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, your User Content, or your violation of any law or third-party rights.

16. Suspension and termination

We may suspend or restrict access to the Site, refuse submissions, or block IP addresses at any time if we reasonably believe you have violated these Terms, pose a security risk, or engage in conduct harmful to FTO-Union or other users. We may also modify or discontinue any part of the Site without notice.

17. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.

Before commencing formal proceedings, you agree to contact us at contact@fto-union.com and attempt to resolve the dispute in good faith within thirty (30) days.

Subject to applicable law, you agree that the courts of New South Wales, Australia shall have exclusive jurisdiction over disputes arising from these Terms or the Site, without prejudice to mandatory rights you may have to bring claims in your home jurisdiction.

18. Changes to these terms

We may revise these Terms at any time by posting an updated version on this page and changing the "Last updated" date. Material changes may also be highlighted on the Site. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
